Role Overview

We are seeking an experienced professional to join our team as a Senior Legal Counsel - Global Legal. This role will involve providing legal advice and guidance to senior management and global businesses across various regions.

Responsibilities
  • Act as a senior advisor and lead lawyer to the Custody (Global Custody and Direct Custody and Clearing) business within HSBC's Securities Services business (SSV) in Asia Pacific Region.
  • Work closely with a global team of advisory and transaction lawyers supporting SSV and the wider MSS business.
  • Provide expert and professional legal advice, guidance, and support to ensure that the legal and reputational risks in the above SSV business lines are identified, reported, and mitigated.
  • Provide advice and assistance with respect to complex client transactions, outsourcing, custody, and digital new product development, assessing and implementing regulatory change and special projects.
  • Support the Head of Securities Services Legal with respect to accountability for all custody transactions and projects managed by onshore and offshore lawyers.
Requirements
  • A qualified lawyer with private practice and/or relevant post-qualification experience with an international bank in a security services business of at least 10+ years PQE.
  • Specialist securities services experience with a strong focus on global and direct custody across transactions and product development (including digital custody) is a must.
  • Up-to-date knowledge and experience of developments in relation to securities services, specifically involving, custody, digital, and related initiatives, outsourcing, collateral management, foreign exchange, post-trade, and ancillary products.
  • Knowledge and experience of banking, corporate, and securities law concepts and a working knowledge of the laws in the major jurisdictions in which HSBC operates, specifically around client asset and client money rules. A working knowledge of relevant regulations in Hong Kong, China UK, EU, and ASP regional (EMIR, FINRA, RG 133, CASS, MiFID II, UCITS, Stock Connect, Bond Connect) is required.
  • Experience with drafting, negotiating, and advising on non-standard/bespoke custody agreements, development of new product terms to meet market demands, and other associated documentation.
  • Working with product on new product approvals and offering in the markets that HBSC operates in.
  • Knowledge of the HSBC Group corporate structures, its business, and personnel and a clear understanding of HSBC's corporate culture.
  • Developing leadership skills.
  • A self-starter, independent with good organisational skills and the ability to prioritise effectively.
  • Excellent communication, negotiation, and inter-personal skills.
  • Lateral thinking/problem-solving.
Salary

The salary for this role is estimated to be between $120,000 and $180,000 per annum, depending on experience.
