We are seeking a Senior Legal Advisor who is familiar with cross-border e-commerce, especially the relevant laws of the Chinese Mainland, to provide comprehensive legal support for the company's cross-border e-commerce business in the Mainland, ensure the compliance of business operations, prevent legal risks, handle cross-border disputes, and protect the legitimate rights and interests of the company and its clients. Key Responsibilities Comprehensively review the relevant laws and regulations on cross-border e-commerce, including but not limited to the aspect of Import and Export Trade, the Customs Supervision, Data Security, Consumer Rights and Interests Protection, Intellectual Property Protection, and tax compliance requirements, etc. In combination with the rules of the online platform, establish a unified cross-border e-commerce compliance management system and operation manual for the group. Draft, review and revise various types of contracts related to cross-border e-commerce, including platform entry agreements, supplier cooperation agreements, logistics and transportation agreements, cross-border payment agreements, overseas distribution agreements, etc., to clarify the rights and obligations of all parties and prevent risks in contract performance. Develop standardized legal document templates (such as user service agreements, privacy policies, after-sales service terms, etc.) to adapt to the legal requirements and platform rules in the Mainland and Hong Kong, ensuring the legality and validity of the documents. Establish a contract ledger and legal document archive management system, track the performance of contracts, handle matters such as contract modification, termination, and disputes, and retain complete legal evidence. In response to the differentiated rules of different platforms in the Mainland (such as Tmall, JD.com, Tiktok, etc.), formulate compliance guidelines for platform entry, operation and exit to ensure the compliant operation of accounts and avoid the risk of platform penalties. Regularly verify the platform's operational behaviors (such as product promotion, pricing, after-sales policies, etc.), and promptly identify and rectify compliance loopholes. Be responsible for data compliance management in cross-border e-commerce business, including user information collection, storage, cross-border transmission and other links, to meet the data protection requirements of the Mainland and Hong Kong, and prevent data security legal risks. Regularly conduct legal risk screening for cross-border e-commerce business, identify potential risk points (such as intellectual property infringement, unfair competition, consumer complaints, tax compliance, etc.), issue risk assessment reports and response plans, and promote risk rectification. Handle legal disputes related to cross-border e-commerce, including negotiation and consultation, complaint response, arbitration and litigation agency, etc., to safeguard the legitimate rights and interests of the group. Continuously pay attention to the cross-border e-commerce policies, laws and regulations, and industry trends in the Mainland, promptly interpret the impact of policy changes on the group's business, provide professional legal opinions, and support the group's strategic decision-making. Provide legal consultation services related to cross-border e-commerce for various departments within the group (such as operations, marketing, procurement, finance, customer service, etc.), answer legal questions during business operations, and support the compliant advancement of business. Requirements  Bachelor's degree or above in law. Qualified Lawyer in Mainland or Hong Kong. More than 15 years of working experience in corporate legal affairs or law firms, including at least 5 years of experience in cross-border e-commerce. Be familiar with the operation rules and intellectual property policies of cross-border e-commerce platforms in the Chinese Mainland (such as Tmall, JD.com, Tiktok, etc.). Proficient in relevant laws and regulations of the Chinese mainland and Hong Kong such as the “E-commerce Law”, “Cybersecurity Law”, “Data Security Law” and “Personal Data (Privacy) Ordinance.” Be familiar with legal issues in cross-border payment, logistics, taxation and other aspects. Practical case experience in handling cross-border legal disputes is preferred. Successful experience in handling cross-border intellectual property infringement cases will be given priority. Fluent in Mandarin and excellent in English, having good writing skills for legal documents in both Chinese and English. Possess strong logical thinking ability, analytical ability and problem-solving ability. Good communication and coordination skills as well as a strong sense of teamwork.
